Debate Over a New Judicial Package in Türkiye Heightens the Urgency of Kaos GL v. Türkiye Before the ECtHR

The TLSP team published a blogpost on Opinio Juris – many thanks to the OJ team for its support – discussing how the debate over a new judicial package in Türkiye heightens the urgency of Kaos GL v. Türkiye before the European Court of Human Rights (ECtHR).

In the pending Kaos GL v. Türkiye (Kaos Gay and Lesbian Cultural Research and Solidarity Association v. Türkiye, App. nos. 27507/23 and 5797/22)  case before the ECtHR, Türkiye-based LGBTQI+ rights NGO Kaos GL argues that systematic bans on Pride marches and public events by organisations promoting LGBTQI+ rights violate multiple rights under the European Convention on Human Rights (ECHR), including freedom of assembly and association and prohibition of discrimination.

Together with the Association for Monitoring Equal Rights (Eşit Haklar İçin İzleme Derneği), the Human Rights Foundation of Turkey (Türkiye İnsan Hakları Vakfı), the Truth Justice Memory Center (Hakikat Adalet Hafıza Merkezi), the University Queer Research and LGBTI+ Solidarity Association (Üniversiteli Kuir Araştırmaları ve LGBTİ+ Dayanışma Derneği), and Women for Women’s Human Rights (Kadının İnsan Hakları Derneği), we submitted a joint third party intervention describing the systematic restrictions on LGBTQI+ assemblies and collective activities in Türkiye, the ineffectiveness of domestic remedies against such restrictions, and a broader pattern of practices violating LGBTI+ individuals’ rights. Our OJ blogpost highlights the continuing denial of LGBTQI+ rights and repeated, systemic attempts by Türkiye’s Government to criminalise LGBTQI+ individuals and LGBTQI+ rights groups. We underline the need for a prompt and firm response by the ECtHR, given the ongoing nature of the issues highlighted by Kaos GL and the Interveners.
